The main problem with civil libertarians is their fundamental incoherence regarding the abstract concept of law https://mises.ca/posts/articles/glenn-greenwald-and-civil-libertarians-double-paradigm-syndrome/

Lisa, what a terrible situation. I’m sorry I don’t know anyone to suggest, but I hope just having some liberty friends can help you feel better.

Hey, Lisa.
I’m so sorry to hear you’re being subjected to this. I don’t know of any liberty-minded family lawyers, but Carlos Morales might be able to help you out.

He knows the system well, and he’s made a bit of a name for himself, so he may know someone who knows someone who can help you.

Hi everyone- I hope this belongs here, and if it belongs elsewhere I’m happy to be redirected. I’m new to this site. I’m here because of my experiences with CPS in NY. Horrific. Nazi style. Armed police officers waking up a family at 6 a.m. Arresting a 14-yr-old who’s getting ready to go to school. Crazy drama, ongoing for three years, and not…[Read more]

Libertarian and law professor John Hasnas writes a lot about tort law and its evolution from customary and common law. I highly recommend reading The Obviousness of Anarchy, What’s Wrong With a Little Tort Reform?, and The Myth of the Rule of Law.

On a related note, Louisiana’s Civil Code was a product of Napoleon’s admiration of the Roman legal tradition of codification. Under the Napoleonic Code, Louisiana is the only state to technically reject precedent as binding law. Here, the only actual law is statutory – codified – because Napoleon’s intention was that any literate person in the…[Read more]

Thanks for posting this Conza. We can all learn more about the application of Mises’ way of seeing to the philosophy of law. It’s inspiring to hear Graf tie together Bastiat, Mises, Hoppe, and Ridley. I’m always interested in how NAP might play out in particular circumstances. For example, was Jefferson’s decision to form a Navy and attack T…[Read more]

I’ve pretty much always been a libertarian; raised that way. But when I actually started paying attention to the State was back in the 80s, when a local farmer was busted for marijuana cultivation. They took his place and most of what he had. BEFORE the trial. Once I started paying attention, I was appalled at how often that was happening! I…[Read more]

I am wondering how many non-lawyers (or lawyers, for that matter) know about civil asset forfeiture? My impression is that many people know about criminal asset forfeiture (where property is confiscated from convicted criminals), but not too many people know about civil asset forfeiture (where property is seized from innocent property owners and…[Read more]
